TERMS AND CONDITIONS

Thank you so much for supporting us!

We care about you and your trip and make sure we do everything possible to assure you are safe and have a wonderful time. In order for these trips to go ahead the group is required to raise enough money to make the project happen, this is why we ask you to contribute to the project. It can not happen without the donations from our big-hearted adventurers. The fee you pay for the trip covers the costs for you to be there and the donations go towards the projects. We work with vendors and tour operators who are blocking off their inventory based on participant numbers. Your deposit is non refundable as these are the terms given to us by the tour operators and payment needs to be made to hold your spot. When we collect your payment in full 90 days before the trip, we are also paying the vendors and giving headcount for participants. The closer we get to the date of the trip, the harder it is to remove participants spots, which is why we can only give refunds in the percentage amounts. Along with this each payment has international transfer fees attached to the transfer.

We are a small company and only work with other small local companies.

We are fair and transparent and want to make sure that everyone is cared about throughout the whole process.

All Travellers must be 18 years of age or older to travel unless they are accompanied by an adult. All travellers must be fit and healthy.


Payment  Terms

Any cancellations made on your behalf will result in the below reimbursement structure.  You must have comprehensive travel insurance that includes cancelation coverage so that you are protected financially in case anything comes up that prevents you from joining your trip.

Deposits: Non-Refundable

Cancellation prior to 120 days before trip: 50% Refund

Cancellation 119 days prior and there after: Non-Refundable

ii) If you do not pay the balance of your trip within 120 days of the departure date, your booking will be canceled resulting in the loss of all money collected.

iii)   If the trip is forced to significantly alter or cancel your trip (not due to any factors outside of our control, such as weather, natural disaster, danger, protests or Partner actions), we will let you know as soon as possible. In these circumstances, you can choose one of the following options:

(1)   Accept TCT's offer of a comparable replacement trip, or

(2)   Receive a refund of all monies paid.

iv)    When accepting an offer for a replacement trip:

(1)   If the cost is lower than the price of your original trip, you will receive a refund for the difference in cost.

(2)   If the cost of the replacement trip is equivalent or higher than your original trip, you will pay the difference at cost price.

We  are not  responsible  for any incidental  expenses that you may  have incurred as a result  of your booking including but not limited to visas, vaccinations, travel insurance excess or non‐refundable flights.

Please  note that  certain of our  suppliers’ cancellation  policies may be more stringent  than our above policy and therefore  the company holds the right to forward  such additional cancellation charges onto the  client should such an instance occur.

If  you fail to join a  tour, join it  after departure, or leave it prior  to its completion, no  refund will be made. If you can not enter a country due to past history, not having the correct visa’s or issue with passport, no refund will be made and any additional fees are to be paid by customer.

Changes  to Booking  ­  

If you would like to transfer your booking to a friend this must be  done 30 days prior to tour departure.

Claims and Refunds

Refunds are not issued for any included activity or trip location that is missed or altered due to circumstances beyond The Conscious Travellers reasonable control, including but not limited to acts of God, war, strikes or labor disputes, significant weather event, government orders or any other force majeure event.

Travel  Arrangements ­  

To confirm your travel  arrangements you must pay the deposit and fully complete the customer form.    

Insurance   

You are required to provide proof of current and adequate travel insurance before the beginning of any trip. Your travel insurance must cover all personal injury and medical treatment including evacuation expenses including international helicopter rescue and air ambulance services.  Your travel insurance must also include coverage for personal property and trip cancellation.

You acknowledge that trip cancellation insurance may be the only means of receiving reimbursement for flights and other non-refundable expenses should you cancel your  trip for any reason, whether voluntarily on your part or as a result of our actions. You are responsible for understanding the specifics of your travel insurance policy, ensuring that your policy covers all optional and included activities listed in the trip itinerary, and that there are no exclusion clauses which would limit the coverage for any activity type.  IT IS YOUR RESPONSIBILITY TO VERIFY YOUR INSURANCE POLICY DETAILS WITH YOUR INSURANCE PROVIDER TO ENSURE THESE REQUIREMENTS ARE SATISFIED.

Personal Responsibility

You are responsible for purchasing the type of trip that fits your comfort level and participating in activities that are suitable for your fitness level and capabilities. By making a booking, you acknowledge that The Conscious Traveller trips are adventurous by nature and may involve a significant amount of personal risk.  They can be emotional and you can be a witness to things that are hard to witness such as poverty, abuse, starvation and medical issues. You understand and assume each and every risk associated with any trip or activities thereto, any of which can cause injury or even death. Risks and hazards that may be present during any trip include, but are not limited to:

  • Travel by automobile or other means of conveyance

  • Hazards of traveling, hiking, exploring, or participating in activities that take place in remote or rugged, unpredictable terrain and where phone or radio communications are unavailable;

  • Risks associated with wildlife encounters while participating in any outdoor activity;

  • Risks associated with crossing roadways and entering/exiting vehicles,

  • The unavailability of immediate medical attention or means of rapid evacuation in case of emergency;

  • Risks of injury, dehydration, or even death resulting from my participation in any sporting or adventurous activity such as boating, surfing, fishing, swimming, diving, parasailing, hiking, yoga, zip lines, rope swings, walking tours, photography tours, vehicle tours, and scenic flights;

  • Mechanical or construction failures of vehicles and equipment;

  • Any physical, mental, or other conditions or disabilities that belong to you or anyone you are traveling you may be a hazard to any group members and may be exacerbated by any of the other risks contained herein;

  • Acts of God, acts of terrorism, forces of nature, and unpredictable weather conditions;Areas of unsafe or unstable conditions due to political or civil disturbances, or other unforeseen circumstances.

In addition to assuming any of the risks and hazards of a trip, some of which are listed above (though a complete listing is not possible), you agree to be responsible for any and all expenses resulting from any inherent risk, whether identified or not, and as a result of your negligence.

 You further certify that you are in an appropriate and good physical condition for participating in the trip of your choosing and to participate in any activities relating thereto, and have the ability to safely engage in adventure travel activities and all other activities in which you may partake while a  passenger. You understand that it is advisable to obtain appropriate medical evaluation and your doctor’s approval prior to initiation of certain travel and/or exercise activities. Your participation in these activities is purely voluntary. No one is forcing you to participate, and you elect to participate in spite of the risks.

TCT reserves the right to decline anyone from joining a trip with justifiable cause. TCT also reserves the right to remove you from a trip if you are creating a hazard to yourself or others, impacting the enjoyment of others, or participating in any illegal activity. Any costs resulting from being removed from a trip or being declined participation in a trip is at your expense.

Passports and Visa ­  

Your  passport  must have  the correct  visa and documents  appropriate to the country  you are visiting. We do not  take responsibility if you are  not allowed into a country for  lack of possessing the correct documents.  You must carry your passport on you at all  times and the passport must have two consecutive  side by side blank visa pages (i.e. a left and a  right hand page). Your passport must have 6 months validity,  Should you passport not comply with these requirements, you will  either not be permitted to board the aircraft or risk deportation on  arrival at your destination.

If Visas are required for the country of travel this is the responsibility of the traveller to purchase or organise visa before the trip.

Baggage

You are allowed to bring one piece of baggage weighing up to (23 kg) (not including donations) and one additional medium/small sized back pack on the trip. If you need to bring additional baggage, let us know prior to the trip. The Conscious Traveller is not responsible for securing or protecting your baggage or belongings at any time during any trip.

Donations

You are able to bring along donations to give to the communities (pencils, books, clothes, pens etc) Be aware of your airlines excess baggage fees including taking an empty bag home after the trip once you hand over the donations.

Haiti - Our Haiti trips include a flight on a small aircraft and is limited to 100kg per person inclusive of luggage. There is an option if you do bring donations that are access of the 100kg to be left on the main land and picked up by a For-You-Haiti representative. Get in touch to talk further.

Inclusions and Exclusions    

Please read the  itinerary you  have booked for  everything that is  included and excluded  in the price. International  flights, visa and passports are  not included in your tour. Additional meals, extended lengths of stay, phone cards are at the expense of the traveller.

Seat Belts

To ensure your safety we recommend that everyone wear their seat belts at all times while riding in any vehicle that is in motion. This recommendation is not only for your safety but also for the safety of everyone else in the vehicle.

Travel Advisories & Warnings

While we continuously monitor the areas we visit, it is your responsibility to become informed about the areas where you are about travel to including any travel advisories and warnings issued by the Smart Traveller https://smartraveller.gov.au

You are responsible for protecting your own well-being and personal property before, during, and after your trip.

Vaccinations and Health   

Medical professional advice is suggested to travellers to get vaccinations to the country you are travelling to.

The Conscious Traveller can only give advice,  and will not be held responsible for costs incurred if entry requirements and vaccination requirements are not met. If you intend to take malaria tablets or any other medication during the trip please consult your doctor, do your research to see if they are right for you. It is the travellers responsibility on all vaccinations, inoculations, or prescribed medications are taken as directed by your local doctor and/or travel clinic for the areas visited.

Optional Activities and Tips

At times throughout your trip, it is likely that you will have the opportunity to participate in activities and/or events that are not included in the trip itinerary. These opportunities allow you to customise your experience and level of adventure on the trip, but keep in mind that The Conscious Traveller does not endorse or sponsor these services. All optional activities are paid for locally and directly to the supplier of the activity, event, or service.

It is understood and acknowledged by the customer that any assistance given by the trip leader or staff to help arrange these optional activities does not constitute a waiver of this disclaimer or create representations and warranties on the part of the Company.  The Conscious Traveller does not sponsor or endorse these activities or events, nor can be held liable for any injury or illness or any consequence whatsoever resulting from your participation. If you decide to participate in these events, you do so voluntarily and are responsible for taking appropriate precautions to ensure your own safety.  

Tips to drivers and persons in service roles is not included in the cost of trip and we suggest to tip those who help you as many people are on below minimum wage and appreciate the generosity.  Suggested to carry small notes or coins on your throughout the trip.

Change  of itinerary ­  

Please  refer to  our website  before departure  for the most recent  updates to your itinerary.  If we make major changes to your  trip we will inform you as soon as   possible. The definition of a major change  is deemed to be a change affecting at least  one day in five of the itinerary. When a major  change is made you may choose between accepting the  change, obtaining a refund of money paid on the land  portion of the trip only or accepting an alternative tour  offered after departure: We reserve the right to change an  itinerary after departure due to local circumstances or events outside  of our control. In such emergency circumstances, the additional cost  of any necessary itinerary alterations will be covered by you. Please note we are not responsible for any incidental expenses that may be incurred as  a result of the change of itineraries such as visas, vaccinations or non-­‐refundable  flights.

The company reserves the right to make changes to the Terms and Conditions at any time without prior notice.

Marketing, Images and Privacy

We will be taking lots of photos during the trip and  use your personal Information to:

  • Facilitate Service ie. trips and events;

  • Improve our services; and

  • Communicate with you.

 Your information will not be provided to any external marketing services.


LIABILITY

All  tours  are booked  and arrangements  are made, on the  express condition that   the company, its employees  and agents, shall not be responsible  for, and shall be exempt from, all liability  in respect of loss, damage, accident, injury, death,  delay or inconvenience to any Client (which shall be  deemed to include the heirs, executors, administrators or  assigns of the Client), their luggage, or other property, wherever,  whenever and however the same may occur. The Client indemnifies and holds  harmless the Company, its employees and agents accordingly. The Company, its  employees and agents shall furthermore not be liable for any consequential loss  or damages whatsoever.

The Conscious Traveller is  a small brand that Jennifer Kyna created to inspire and  encourage others to help others  in need. Jennifer Kyna is not to  be held responsible for any accident, death, loss, theft of property that may  occur on the tours. You are to agree that  you will take full responsibility for yourself  and possessions whilst on the trip. If any death,  loss, accident, sickness is to occur during the trip  no member of your family/friends can take legal action against  Jennifer Kyna.
